Today in the Senate

The Senate will convene at 9:30 a.m. Following Leader remarks, the Senate will proceed to the consideration of motions to proceed to the following budget resolutions, en bloc: S.Con.Res.41 (Senator Sessions-his interpretation of the Obama budget); H.Con.Res.112 (Congressman Ryan); S.Con.Res.37 (Senator Toomey); S.Con.Res.42 (Senator Paul); and S.Con.Res.44 (Senators Lee, Paul, DeMint).

There will be up to 6 hours for debate on the motions to proceed, equally divided and controlled between the two Leaders or their designees.  Upon the use or yielding back of time (at approximately 4:00 p.m. if all time is used), the Senate will conduct up to 5 roll call votes on the motion to proceed to each concurrent resolution.  There will be 2 minutes of debate between each vote and all votes after the first vote will be 10 minutes in duration.

During my time in Congress, I have worked hard to provide sufficient consumer protections to South Dakotans and fight the growing crimes of identity theft and fraud. The Federal Trade Commission (FTC) recently announced that identity theft topped its annual list of consumer fraud complaints, comprising accounting for 255,000 of more than 686,000 complaints filed with the agency in 2005. The Fair and Accurate Credit Transactions Act (FACT Act), which we helped lead through the Senate, creates a number of new programs to stem the tide of identity theft and protect the billions of dollars that victims, as well as the banking and credit industries, lose to ID theft each year.

The FACT Act, which took effect in 2005, requires financial companies to help victims of identity theft and creates a number of programs to increase financial literacy among consumers. Previously, victims of identity theft had only two years to bring actions for violations-often before identity theft victims even knew there was a problem. This legislation extends that time period, allowing victims two years from the date they discover the crime or five years from the date of the crime itself to deny their financial liability. Moreover, the FACT Act ensures that every consumer can receive one free credit report each year. By reviewing credit reports annually, consumers can determine whether there are any inaccuracies, whether they are accidental or result from identity theft.

Also, I was a sponsor of the Identity Theft Penalty Enhancement Act (S. 153) which increased criminal penalties for aggravated identity theft. The House version of this legislation, H.R. 1731, was signed into law in 2004. Finally, I supported the Data Security Act of 2006 (S. 3568), which aimed to increase security procedures for sensitive information of consumers. Though the Data Security Act of 2006 failed to pass, I intend to continue my support of similar legislation in the future.

The FTC also found that the volume of unsolicited commercial email, also known as Spam, has leveled off and that Internet users report less frustration with Spam than in the past. Spam often contains fraudulent routing information or header information that is intentionally false or misleading. This improvement is attributed to the CAN SPAM Act (S. 877), which became effective on January 1, 2005, as well as better anti-Spam technology. Additionally, I supported US Safe Web Act, giving regulators greater ability to fight Spammers who operate outside the US. I will continue to encourage victims of identity theft and all other consumer fraud to report such crimes to the FTC online at www.ftc.gov.

I am pleased that so many of our local banks and credit unions are already actively involved in helping South Dakotans improve their financial literacy, and I hope that the increased national attention on this issue will encourage people across America to learn how to take control of their personal finances.
